Terms of Service

When a customer desires to subscribe the License for the ABBAR Electronic Point of Sale Propert of Mahmoud Saleh Abbar Co. hereby called as Licensor, the customer hereby agrees as follows:

  1. The Licensor is the owner of the copyright and all other intellectual property rights.
  2. The Licensor grants to the Customer, a non-exclusive license to use, upon the agreed terms and conditions.
  3. The Customer is deemed to have read, understood and agreed to the terms of this Agreement.
  4. The ePOS is a Software as a Service (SaaS) Product and will be referred to as Product in the document.
  5. All Customer Data along with the Software will reside on the hosting server of the choice of Licensor, rest assured all international standard security protocols applied on database.
  6. The customer is entitled to use this product once the payment is made as agreed by the customer by selecting the module and pricing of the services.
  7. The Licensor has exclusive right to suspend the service without any further notice if the subscription renewal fee is not paid in advance as prescribed on our website.
  8. Upon termination or expiration of the Subscription, the licensor shall immediately cease providing the Services and all usage rights granted terminate.
  9. No data will be retained whatsoever on the server for the terminated customers.
  10. Old data will be activated only in case of reactivation of subscription within 15 days from the date of expiry of the subscription.
  11. Up to 3 years of data will be retained on the hosting server for customer access; subsequently, the data will be archived and deliver to the customer, however, this data will not be accessible thru subscribed products.
  12. The customer will have no option to backup data offline; except thru report generation or export option from report generation.
  13. The Licensor has extended the right of usage to the customer limited to the version, user and duration as per the plan selected and paid for by the customer.
  14. The Customer shall not decompile, disassemble or otherwise modify, except as provided for by this license.
  15. The Customer is solely responsible for determining the suitability for the purpose it is intended to be used, before the subscription of the License. Once the Customer subscribes to the License, the Licensor will not accept the return under any circumstances, whatsoever, and the payment once made shall be non-refundable.
  16. The Product needs to be registered before it can be used. The Product will work only when it is successfully registered.
  17. The Customer shall take all reasonable precautions and measures to protect the Product and related items from unauthorized use, and access.
  18. The fee of the Product is the license fee for use of the Product only. All services like Installation, Training and Support etc. are chargeable extra.
  19. After a new version is released, all further development will be carried out on the new version only, which may be subject to the acceptance of further terms and conditions between the parties.
  20. The Licensor does not guarantee the compatibility of the Product with all browsers and Operating Systems / Technologies.
  21. The Licensor shall not take any responsibility for any kind of corruption of data due to media failure/power failure/hardware problem/virus infection or any other reason.
  22. It is expressly agreed by the Customer that Licensor shall not be liable for any loss or damage, whether direct, indirect, special, consequential and/or incidental, arising from the use or application of the Product and related items.
  23. The Reports provided in the Product are intended to provide the information/data to the Customer, which is required for fulfilling various obligations. The Licensor does not guarantee, promise or claim accuracy, completeness or adequacy of the information provided and makes no claim that the Reports provided in the Product will be accepted by the relevant authorities as it is. The Licensor shall not be responsible for any error/omission or delay in fulfilling obligations by the Customer. In case there is any change in requirement, the Licensor shall try to incorporate the same in the forthcoming releases of the Product, but, shall be under no obligation to do so.
